The current operating expectations, written plainly, with the fuller legal version underneath.
While Flare is in this early stage: posting problems, viewing opportunities, and replying are free. Flare does not process payments, does not employ the people who respond, and does not verify licenses, insurance, or identity yet. Do not assume any professional is vetted. Flare is not an emergency service. You are responsible for the work you agree to and the people you let into your home. Don’t post illegal, harassing, or deceptive content. Flare may remove content or accounts that break these rules.
Some features require an account. You agree to provide accurate information and keep it current. You’re responsible for keeping your login credentials confidential and for activity under your account; tell us right away if you think someone else has accessed it. You can delete your account at any time from your profile page — see Delete your data for exactly what that removes.
You must be at least 18 years old to use Flare.
Anyone who responds to a problem, takes a job, or otherwise helps through Flare does so as an independent individual or business, never as a Flare employee, agent, or contractor. Flare does not direct, supervise, schedule, or control how the work is performed, does not set prices beyond what a customer and professional agree between themselves, and takes no cut unless a job is confirmed solved. A professional is solely responsible for their own taxes, licensing, insurance, and compliance with the law in the work they perform. Nothing in these Terms, or in using Flare, creates an employment, agency, joint-venture, or partnership relationship between Flare and anyone who uses it.
Subject to these Terms, Flare grants you a limited, non-exclusive, non-transferable, revocable license to access and use the site for your own personal or, for professionals, business purposes of finding and responding to real problems. You may not resell, sublicense, or commercially exploit access to the site itself; reverse-engineer or scrape it to build a competing product; or copy, republish, or redistribute its content except as these Terms allow.
Flare may modify, suspend, or discontinue any part of the product at any time. All intellectual property in the site and its content belongs to Flare or its licensors; these Terms don’t transfer any of it to you beyond the limited access above.
If you send Flare feedback or suggestions, you’re giving Flare permission to use them freely, without owing you anything for it — don’t send anything you consider confidential.
Your use of Flare is also governed by the Privacy Policy, which describes what information Flare collects and how it’s used and shared. If the two documents ever conflict on how your personal data is handled, the Privacy Policy controls.
What happens between you and another user, including any work you agree to and anyone you let into your home or let work on your property, is between the two of you. Flare doesn’t vet, employ, or guarantee anyone on the platform today (see Safety), and isn’t responsible for loss or harm arising from those interactions. To the fullest extent the law allows, you release Flare from claims arising out of your dealings with other users or with any third-party service Flare happens to link to or use. Flare may, but has no obligation to, get involved in a dispute between users.
FLARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FLARE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, AND DOES NOT WARRANT THE QUALITY, SAFETY, OR LEGALITY OF ANY WORK ARRANGED THROUGH IT.
TO THE MAXIMUM EXTENT THE LAW ALLOWS, FLARE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SITE, OR FROM WORK ARRANGED THROUGH IT. FLARE’S TOTAL LIABILITY FOR ANY CLAIM UNDER THESE TERMS IS CAPPED AT THE GREATER OF $50 OR THE AMOUNT, IF ANY, YOU PAID FLARE IN THE SIX MONTHS BEFORE THE CLAIM AROSE — WHICH TODAY IS $0, SINCE FLARE DOESN’T PROCESS PAYMENTS YET.
These Terms apply for as long as you use Flare. Flare may suspend or end your access at any time, including for breaking these Terms, and isn’t liable to you for doing so. Parts of these Terms that are meant to outlast your account (ownership, releases, warranty disclaimers, liability limits, and this sentence) keep applying after it ends.
California: you may report complaints to the Complaint Assistance Unit, Division of Consumer Services, California Department of Consumer Affairs, 1625 N. Market Blvd. Suite N112, Sacramento, CA 95834, (800) 952-5210.
Colorado, Connecticut, and Virginia each have their own consumer-data-privacy laws (CPA, CTDPA, VCDPA) giving residents rights over their personal data; Nevada gives residents the right to ask a business not to sell certain data about them. See the Privacy Policy for what Flare actually collects and how you can reach Flare about it — Flare is early-stage and most of the formal thresholds these laws gate heavier obligations behind don’t apply yet (see docs/LEGAL_COMPLIANCE_NOTES.md), but the underlying rights are stated here regardless of size.
Flare may update these Terms; material changes will be posted here (or emailed, once Flare sends account email). Continuing to use Flare after that means you accept the update. These Terms are governed by California law. Using Flare means you’re OK getting notices from Flare electronically instead of on paper. Flare is committed to the site being usable by people with disabilities — see Accessibility — and wants to hear about anything that isn’t working, at the same place Report something goes.
If part of these Terms turns out to be unenforceable, the rest still applies. Flare not enforcing something once doesn’t waive the right to later. You can’t transfer your rights under these Terms to someone else without Flare’s OK; Flare can transfer its own rights freely (for example, if the company is acquired).
